Terms and Conditions of Sale
The Pinguino Guy
Last updated: 16.10.2026
These Terms and Conditions govern the sale of products through the website https://thepiuminoguy.com/ (the "Website"), operated by CR Studio di Rivetti Chiara (the "Seller"). By placing an order, you (the "Customer") confirm that you have read and accepted these Terms and Conditions. They are drafted in accordance with the EU Consumer Rights Directive 2011/83/EU and the Italian Consumer Code (Legislative Decree 206/2005).
1. Seller identity
TPG di Rivetti Lorenzo - Via A. Giordani 14, Pisogne BG - P.IVA. 04822650984 - CF. RVTLNZ99S04B157R - SDI: M5UXCR1 - pec: thepiuminoguy@pec.it
2. Products
The Seller sells luxury down jackets and related apparel through the Website. Product images, descriptions and colours are provided for illustrative purposes and may differ slightly from the actual product due to screen settings. The essential characteristics of each product are described on the relevant product page. All products are subject to availability.
3. Prices
All prices are shown in EUR and include VAT where applicable. Prices do not include shipping costs, which are calculated and displayed separately before you complete your order. The Seller reserves the right to change prices at any time, but the price applied to your order is the one displayed at the time the order is confirmed.
4. How the contract is formed
To place an order, you select the products, add them to your cart and follow the checkout procedure. Before confirming, you can review and amend your order. By clicking the order confirmation button, you submit a binding purchase order. The contract of sale is concluded when the Seller sends you an order confirmation by email. If a product becomes unavailable after your order, the Seller will inform you promptly and refund any amount already paid for that product.
5. Payment
The Seller accepts the following payment methods: credit and debit cards. Payments are processed through secure providers. The Seller does not store your full card details. Products remain the property of the Seller until full payment has been received.
6. Shipping and delivery
Estimated delivery times and shipping costs are shown at checkout. Delivery times are indicative and are not binding deadlines, unless otherwise agreed in writing. Risk of loss or damage to the products passes to you when you, or a third party designated by you, take physical possession of the goods.
7. Right of withdrawal (14 days)
If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason.
Withdrawal period. The withdrawal period expires 14 days from the day on which you, or a third party designated by you (other than the carrier), acquire physical possession of the goods. Where your order consists of multiple goods delivered separately, the period runs from receipt of the last item.
How to exercise the right. To exercise your right of withdrawal, you must inform the Seller of your decision by a clear statement (for example a letter sent by post or an email) before the withdrawal period expires. You may use the model withdrawal form set out in the Annex, but this is not obligatory. Contact details for withdrawal:
- Email: shop@thepiuminoguy.com
- TPG di Rivetti Lorenzo - Via A. Giordani 14, Pisogne BS
Effects of withdrawal. If you withdraw, the Seller will reimburse all payments received from you, including the standard delivery costs (but not any extra costs arising from your choice of a delivery type other than the least expensive standard delivery offered). The Seller will make the reimbursement without undue delay and no later than 14 days from the day it is informed of your decision to withdraw. The Seller may withhold reimbursement until it has received the goods back, or until you have supplied evidence of having returned them, whichever is earliest. Reimbursement will be made using the same means of payment you used, unless you expressly agree otherwise, and in any event at no additional cost to you.
Returning the goods. You must send back or hand over the goods without undue delay and in any event no later than 14 days from the day you communicate your withdrawal. The deadline is met if you send back the goods before that period expires. You will bear the direct cost of returning the goods, unless the Seller has agreed to bear it or has failed to inform you that you must bear it. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Exceptions. The right of withdrawal does not apply, among other cases, to goods made to your specifications or clearly personalised, and to sealed goods that are not suitable for return for health protection or hygiene reasons and were unsealed after delivery. Where an exception applies to a product, it will be indicated on the relevant product page.
8. Legal guarantee of conformity
As a consumer, you benefit from the legal guarantee of conformity provided by the Italian Consumer Code. The Seller is liable for any lack of conformity that becomes apparent within 2 years of delivery. In case of a defect, you are entitled to have the goods brought into conformity through repair or replacement, or to an appropriate price reduction or termination of the contract, under the conditions set out by law. To make a claim, contact the Seller at shop@thepiuminoguy.com.
9. Returns procedure
To return a product, whether under the right of withdrawal or the legal guarantee, please contact the Seller in advance at shop@thepiuminoguy.com to receive instructions. Products should be returned in their original condition and packaging where possible, with any tags attached.
10. Complaints and dispute resolution
You may submit complaints to the Seller at shop@thepiuminoguy.com. If a dispute cannot be resolved directly, you may access the European Commission Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. This does not affect your right to bring proceedings before the competent courts.
11. Liability
The Seller is not liable for delays or failures in performance caused by events beyond its reasonable control (force majeure). Nothing in these Terms and Conditions limits or excludes the Seller's liability where it cannot be limited or excluded under applicable law, including liability for consumer rights.
12. Intellectual property
All content on the Website, including text, images, logos, graphics and the "The Pinguino Guy" brand, is protected by intellectual property rights and may not be used, reproduced or distributed without the prior written consent of the Seller or the respective rights holders.
13. Applicable law and jurisdiction
These Terms and Conditions are governed by Italian law. For consumers, the mandatory provisions of the law of the country in which the consumer resides continue to apply, and the competent court is that of the consumer's place of residence or domicile, where located within the EU.
14. Changes to these Terms
The Seller may amend these Terms and Conditions from time to time. The version applicable to your order is the one in force at the time the order is placed.
